Consortium Policies

Intellectual Property Policies

Although it is not expected that there will be any inventions or patents derived directly from the work of the Center, the following intellectual property policies will apply to all work conducted by the Center as a matter of NSF policy applying to all I/UCRCs:

  • All patents derived from Subject Inventions conceived or first actually reduced to practice in the course of the research conducted by personnel of the Center shall belong to the University of California, Irvine;
  • Inventions made with support from the National Science Foundation shall be subject to the provisions contained in the NSF Grant Policy Manual (NSF-00-2);
  • The University agrees that all Center sponsors are entitled to a nonexclusive nominal royalty bearing license to patents derived from Subject Inventions if such license is requested by the sponsors. If member companies request that the University file and prosecute a patent application so that they can exercise their rights to a royalty free license, the requesting companies agree to pay the full costs of the patent application;
  • In the event that only one company sponsor seeks a license, the University may negotiate a nominal royalty bearing exclusive license with that company. The company has the right to sublicense its subsidiaries and affiliates.

Research Dissemination Policies

  • Research results are disseminated through normal academic and professional publication.
  • Industry participants receive the results early. They will also receive early drafts of research papers for review. They receive reprints of published articles.
  • Requests for review/clearance on working papers resulting from Center sponsored research are sent to IAB members via registered or similar mail. No response within 30 days is considered tacit approval for dissemination of the information. Written responses that raise concerns will be resolved within 60 days.
